What is Expungement?

If you have a misdemeanor or felony on your record, and have completed a sentence that did not include state prison, there's a way to stop most of the problems that come from it. California Penal Codes 1203.4 and 1203.4a give you the opportunity to have your convictions set aside, and a guilty or no contest plea changed to not guilty. This can help you secure employment, obtain a professional license, and avoid certain immigration consequences. While this does not seal your record, it will get you back on track to live life on your terms.

Prop 47 Relief

​

In 2014, California passed a law that makes it possible for people with certain felonies on their record to have them changed to a misdemeanor, and to reduce the sentence they're serving. This is an effective way to stop a lot of the lingering problems that arise from having a felony on your record. This is only going to be in effect for a limited amount of time, so if you want to use Prop 47 relief, it's important to act as soon as possible.

Prop 64 Relief for Prior Marijuana Convictions

Proposition 64, the “Control, Regulate and Tax Adult Use of Marijuana Act,” commonly known as the “Adult Use of Marijuana Act”  was adopted by the voters on November 8, 2016. Under Prop 64 you may qualify to have your prior offense designated as a misdemeanor or infraction, and even have the case dismissed and sealed. If you are currently serving probation, or are serving out jail time now for a marijuana offense, you may obtain a reduced conviction or sentence.

Prop 64 effects the following marijuana offenses:

Possession of marijuana

Planting, harvesting or processing marijuana

Possession for sale of marijuana

Unlawful transportation, importation, sale or gifting marijuana

Failure to Disclose Immigration Consequences

​

If you are facing deportation because you plead guilty to a crime, you may be able to avoid leaving the country. Under PC1473.7 you can seek relief for not being fully informed that your conviction would carry immigration consequences. With the recent judgement in the California Supreme Court case of The People v. Patterson, even if you were informed that it would be possible for you to face immigration consequences, you may still be able to seek relief if you were not given specific information on how a guilty plea would affect you.

Drug Diversion

​

If you successfully completed a Drug Diversion program that was offered in exchange for a plea of guilty, you may be able to seal your court and police records. PC851.90 gives you the opportunity to keep drug offenses from being part of your record as long as you complete your Drug Diversion program without problem.
